Terms of Use

1. Identification and Scope
These terms of use (the ” Terms “) govern access to the website bifco.shop (the ” Site “) as well as any order of products or services from Bifco Motors and Transmissions (” BIFCO “, ” we “), whose place of business is located at 3995 Lite Boulevard, Laval, Quebec H7E 1A3, Canada.
By browsing the Site, creating an account, or placing an order, you accept these Terms. If you do not agree to them, please do not use the Site.
The Terms apply in conjunction with the following policies, which form an integral part thereof :
- the Warranty Policy ;
- the Shipping Policy ;
- the Return and Refund Policy ;
- the Privacy Policy.
In the event of any discrepancy between these Terms and any of these policies, the specific policy shall prevail with respect to the matter it governs.
2. Eligibility
You must be at least 18 years of age and have the legal capacity to enter into contracts to place an order. If you are acting on behalf of a business, you represent that you are authorized to bind it.
3. Products
BIFCO sells engines, transmissions, and mechanical parts new or used. Used parts are sold as is, subject to the applicable warranty described in Section 8.
Photographs, mileage, part numbers, and descriptions are provided for informational purposes only and may differ from the actual part delivered. The customer remains responsible for verifying the compatibility of the part with their vehicle prior to installation, notably by using the vehicle identification number (VIN) and original part numbers. We invite you to contact our team to verify compatibility before ordering.
Product availability is not guaranteed until the order has been confirmed in writing by BIFCO.
4. Prices, taxes and errors
Prices are displayed in Canadian dollars (CAD) and exclude applicable taxes (GST and QST), shipping fees, and, if applicable, core charges (« core charge ») which are indicated separately.
BIFCO reserves the right to correct any pricing or description error and to cancel any order affected by such an error, even after confirmation. In such cases, any amount already paid will be fully refunded.
5. Orders, deposit and payment
An order constitutes an offer to purchase. The contract is only formed once BIFCO confirms the order.
A deposit may be required to initiate the search and reservation of a part. The balance is payable according to the terms set out on the invoice. Accepted payment methods and the applicable schedule are specified on the invoice, which prevails in the event of any discrepancy.
BIFCO reserves the right to refuse or cancel any order, particularly in the event of suspected fraud, obvious error, or supply issues.
6. Delivery and pickup
Delivery terms, times and fees are described in the Shipping Policy. Delivery times are estimates and do not constitute a contractual commitment, unless otherwise stated in writing.
It is the customer’s responsibility to inspect the part upon receipt and to immediately report any shipping damage or apparent non-conformity.
7. Returns and refunds
Returns and refunds are governed by the Return and Refund Policy.
8. Warranty
The warranty applicable to each part is described in the Warranty Policy. The exact duration of the warranty is indicated on the invoice and prevails at all times.
The customer acknowledges that the warranty is subject to mandatory installation conditions (including correcting the cause of the original failure, replacing required maintenance parts, flushing systems, complying with fluid specifications, and the mandatory 1,500 km follow-up) and that no claim is admissible without prior written authorization from BIFCO.
Installation must be performed by a qualified mechanic. Improper installation, opening or modifying the part, or any vehicle performance reprogramming voids the warranty.
Nothing in these Terms limits the rights granted to consumers under the Quebec Consumer Protection Act, including the legal warranty of quality and durability.
9. Customer Responsibility
The customer is solely responsible :
- for validating the compatibility of the ordered part ;
- for diagnosing and correcting the original issue ;
- for choosing and supervising the shop or mechanic performing the installation ;
- for fully complying with the installation conditions set out in the warranty.
10. Limitation of Liability
To the extent permitted by law, and subject to the mandatory rights granted to consumers by the Consumer Protection Act, BIFCO’s total liability with respect to an order is limited to the purchase price paid for the part in question.
BIFCO cannot be held liable for indirect damages, including labour costs, towing, vehicle rental, loss of use, loss of income, or delays, except to the extent prohibited by law.
11. Electronic Communications
By providing us with your contact information, you consent to BIFCO communicating with you by email, text message (SMS), telephone, or social media messaging (including Facebook Messenger and TikTok) regarding your quote requests, orders, and after-sales service.
These conversations may be recorded and stored in our internal systems to ensure follow-up, service quality, and compliance with our legal obligations. You may withdraw your consent to marketing communications at any time by writing to us at ventes@bifco.shop. The processing of your personal information is described in the Privacy Policy.
12. Intellectual Property
The content of the Site (text, images, logos, layout) is the property of BIFCO or its licensors and is protected by applicable laws. Any unauthorized reproduction or use is prohibited.
13. Acceptable Use of the Site
It is prohibited to use the Site for unlawful purposes, to extract its content in bulk using automated means, to compromise its security, or to impersonate a third party.
14. Personal Information
The collection and use of personal information are governed by the Privacy Policy, in compliance with the Act respecting the protection of personal information in the private sector of Quebec.
15. Modification of the Terms
BIFCO may modify these Terms at any time. The version in force is the one published on the Site at the date of your order. The date of the last update appears at the top of this document.
16. Governing Law and Jurisdiction
These Terms are governed by the laws applicable in the Province of Quebec and the laws of Canada applicable therein. Any dispute falls under the exclusive jurisdiction of the courts of the judicial district of Laval, Province of Quebec, subject to mandatory consumer protection rules.
In accordance with the Charter of the French Language, the parties agree that these Terms are drafted in French.
